Validity and effectiveness of contracts on websites

This collective work is part of the research entitled “Limits to the autonomy of will in Wrap contracts”. The study starts from the need to analyze in the national and international context the application and regulations of new forms of contracting through digital portals: Wrap contracts. These legal figures have developed in Anglo-Saxon law, but their usefulness has spread throughout the globe, thanks to the development of ICTs (specifically, the Internet). These new contractual forms have generated benefits for economic development and circulation of goods and services and have been enshrined through electronic commerce and contracting. However, as a result of their application, various doctrinal debates have arisen about the limits that can be set in relation to the autonomy of will of contractors since they can only express their consent through electronic mechanisms without any negotiation and sometimes without knowing beforehand terms of contracting. National legislations do not present clarity on this subject and doctrine has not provided a precise answer to these phenomena that arise from new globalized trends in law. Therefore it is necessary to carry out research that demonstrates legislative inconsistencies presented by Colombian regulations specifically to make a concrete proposal to address this issue.
